This image hides many things, including:

1. the slow but steady dispossession of smallholder (often African-American) farms that have been overtaken/bought out by Smithfield Foods to enlarge the industrial footprint of CAFOs;

2. the hogs themselves, whose hooves never touch the ground as they stand on "hog slats" inside the hangers as they move through the Fordist stages of transformation from individual animals into packaged pork;

3. the human operators, themselves, who are rarely wealthy, and are contracted for decades (or life) to purchase all "inputs" (feed, semen, etc) from Smithfield; in 2010, I took my EJ class from UNC-Chapel Hill to visit one of these operators at his CAFO, outside Raleigh, NC, and he was battling Smithfield and Duke Energy to be allowed to erect and operate a small-scale, experimental wind turbine that ran on methane captured from his pigs; years later, individual efforts at small-scale biogas would be overtaken by entities like Align LNG which now, in Sampson County, proposes the "Grady Road Project" to scale-up factory-farmed methane gas capture from much larger operations;

4. the legacy of resistance to this form of agricultural production, led by community-based intellectuals like Gary Grant, who as early as the 1980s was speaking out, traveling to state and federal lawmakers, publishing, and organizing against the growing harms of CAFOs in his home territory of Halifax County, NC. [See the suggested readings by Gary Grant and Steve Wing, Naeema Muhammed and others, that tracks this organized resistance and the formation of several community-based EJ groups in response].

Bridging Gaps in Publicly Accessible Data

How are Data Gaps Worked Around:

Sarnia, and the surrounding area around chemical valley, have 9 air monitoring stations in which air pollutants are monitored from the nearby petrochemical complex. Until 2017, only data from one of these stations (the one on Christina Street in downtown Sarnia) was publicly available. This created a gap in accessiblility of important data for sarnia and the nearby AFN residents. In September 2015, the Clean Air Sarnia and Area group launched as a "community advisory panel made up of representatives from the public, government, First Nations, and industry, who are dedicated to providing the community with a clear understanding of ambient air quality in the Sarnia area." This group works to improve air quality in Sarnia by making information about air quality publicly available and by making recommendations to relevant authorities. In 2018, this group launched the website: https://reporting.cleanairsarniaandarea.com/ (also uploaded as an artifact) which allows public to access data from the air quality monitoring stations and understand how air quality compares to Ontario's standards. This site works to fill the gap of publicly available air quality data in Sarnia.

Standards Undercutting Safety

This report from Ecojustice shows a decline in air pollution compared to Ecojustice's first report released in 2007 for the area around Chemical Valley, yet Sarnia industries continue "to release far more pollution, and in particular far more SO2 , than comparable U.S. refineries." One contributor to the continued excessive emissions is Ontario's lagging air quality standards. The report notes that "Ontario’s AAQC and air quality standards are lagging behind current science on the health impacts of air pollutants, which may put the health of residents at risk." The report highlights pollutants where Ontario's standard is above the national standard or where Ontario has no standard at all. Additionally, Sarnia's benzene emissions are exempt from Ontario's health-based standard for this chemical and are instead regulated by  "an industry technical-based standard" allowing benzene levels to be far higher than the health-based standard. The lagging, lack of, or exemption from regulation undercut efforts in monitoring and reducing emissions to a "safe" level as what is considered "safe" by standards is out of line with what is considered "safe" by health and other standards.

The article contains quotations attributed directly to the judge, so I would presume she was either present for the ruling or accessed the case brief. This would also be where Ms. Preston could obtain direct quotations from the plantiff's arguments. Additionally, the article includes statements from the EPA, public officials, and Senator Rodham Clinton; these would either be from official public releases or interviews by government personel.

The article debriefs a ruling by Federal District Court Judge Deborah A. Batts on a class action lawsuit against the EPA. It details the claims made by the plantiffs' surrounding EPA officials' misconduct after 9/11. Specifically cited are Christie Whitman, who chaired the EPA  during the attacks, and several other EPA officials.

Judge Batts: Deborah A Batts, sitting judge of the Manhattan Federal District Court at the time of these proceedings. She handed down the ruling that allowed the pursuit of the class action lawsuit.

Christie Whitman: Former EPA "leader" (chair) at the time of the 9/11 attacks. She and several other officials (unnamed in this article) are accused of misleading the public about air quality surrounding the tower site.

EPA: Environmental Protection Agency. Federal agency charged with matters pertaining to the environment, particularly those that concern public health. The EPA often aids in creating standards for environmental safety (including pollution and airborne particles).

The article's primary focus is the failure of a government agency in the wake of the 9/11. The EPA's inadequate response to air pollution and subsequent public misguidance led to a multitude of public health issues. While the article does not explicitly detail the issues stated in this lawsuit, it does mention the EPA's failure to properly formulate and enact a plan to clean up materials released into the air.

1) EPA: what are the exact duties and responsibilities of the EPA after a disaster? While we mostly consider it to focus on pollutants and environmental conservation, both this article and FEMA training seem to indicate it holds a much larger role in emergency situations.

2) Christie Whitman: a former governor of New Jersey and Administrator of the EPA from 2001-2003, Whitman served during the 9/11 attacks. Despite pointed personal criticism about her time in the EPA (including legal action), Whitman historical demonstrated a pattern of moderatism, often putting her at odds with the administration she served. It would be interesting to see where in the 9/11 lapse emerged-- whether it be from judgement, misinformation, or disinterest.

3) 9/11 Health Effects: The release of millions of asbestos and concrete particles into the air certainly increases the odds of chronic respiratory issues for NYC populations. I would be interested in whether any other chronic issues or epidemics have been noted as a result of pollution from the Towers' collapse

Preston's article mentions the EPA still had not formulated and enacted a plan for cleanup-- it should be noted the year of publication was 2006. She claims "After an expert panel failed last year to settle on a method for organizing an E.P.A. cleanup, the agency said it would proceed anyway with limited testing and cleaning". Moreover, in the 10 years since publication, several studies have indicated increased public health risks and chronic illness prevalence in populations near the disaster zone. It seems the approach of sit-and-wait did nothing but exacerbate the issue, leading me to believe this will serve as a symbol in any future pollutant-laden disasters.
