Overview of Formosa Drainage Study

This supplementary legal document describes recommendations for storm- and waste-water management improvements for the Formosa petrochemical plant in Calhoun County, Texas. The text is a fairly standard drainage assessment. The author describes non-trivial discharge of pollutants out of the plant’s outfalls, which drain into local waters, and the inability of the plant’s systems to prevent flooding from even small storms. For some context on this, it is pretty standard to design a stormwater system to be able to drain the 100-year storm (that is, the storm with a 1% or less chance of occurring in any given year). Formosa’s Texas plant demonstrated the inability to convey even the 2-year storm.

Problem areas were identified based on the results from the outfall drainage studies provided by Formosa. Thus, all the results in the OPCC rely on those studies, uncertainities associated with those studies, and the assumptions made for those studies, some of which may or may not be appropriate as I pointed out in Supplement #2 [Page 4]” (3)

“The proposed improvements assume that the conveyance capacity of the problem areas is increased 100%, which would be able to handle twice as much flow that it currently does. The results from the Drainage Study are not conclusive as to what storm event Formosa’s system currently is capable of conveying. The report does mention that the system is not capable of conveying the 2-year storm, and “sometimes” not even the 1-year storm event. (3)

“A 45% contingency is applied to the OPCC due to the uncertainties associated with underground utilities, likelihood of existence of low road crossings and need to replace those, groundwater impacts, other unknowns, and additional costs associated with engineering, etc. 45% is reasonable and in line with industry practices in my experience, especially given the large amount of unknown information available.” (4) 

“My opinion from my July 9, 2018 report that “there have been and are still pellets and/or plastic materials discharges above trace amounts through Outfall 001” is further supported by the deposition testimony of Lisa Vitale, as representative for Freese & Nichols, Inc, that she and her colleagues have seen floating white pellets or small plastic pieces in Lavaca Bay and in the area near outfall 001 as part of her work on the receiving water monitoring program for Formosa’s TPDES permit...Ms. Vitale also testified that she told John Hyak of Formosa about these sightings as well as has sent him water samples with the pellets about five or six times, including at least one time prior to 2010. This, along with the June 2010 EPA Report I cited in my July Report, demonstrates to me that Formosa was aware of problems related to discharges of plastics from its facility since at least in 2010.” (6)

I think Spivak's "Subaltern Studies Deconstructing Historiography" could offer two interventions:

(1) First, her notion of "cognitive failure" is helpful to understand how COVID-19 is unfolding. For her, it is not being able to grapple the object of analysis: “Unless the subject separates from itself to grasp the object, there is no cognition, indeed no thinking, no judgment.” She writes this statement to talk about the Marxist and anti-humanist tendency to abhor cognitive failure and see it as inducing paralysis. For Marx and Gramsci, for example, this has been a question of the proletariat class recognizing that they are excluded from the labor of their own bodies, through which their shared consciousness can arise.

For Spivak, however, through her critique of the Subaltern Studies collective,  there is no escape from cognitive failure. Just as it is okay that the collective will not be able to speak for the subaltern as much as there is value in it, it is alright to not be able to grapple. The COVID-19 moment is instructive of failures upon failures: failure of neoliberalism, of the nation-state, of parochial activism, of scholarly projects. It is a failure of not being able to do anything even though we have a shared consciousness of failure. It is a failure of being able to be a person, or even being mourned with dignity. Spivak, through her stubborn insistence on being able to build from failure and residues, says that our usual ways of performing scholarship, activism, and subalternity will not work. We have to be able to come together from a point of exhaustion and failure. 

(2) Second, Spivak opens up the question of how we construct oppression and exclusion in the archive, especially if the oppressed and excluded figure is not present. The way COVID-19 is unfolding builds upon histories of institutional and informational opaqueness. How do we read absences of the archive, or "against the grain", against institutional and informational opaqueness?

The training of and role of the intellectual / humanist

The training of and role for the (humanist?) intellectual in the world seems to be a relevant take-away point of discussion from postcolonial theory. I have been noticing a proliferation of thought pieces and various genres of writing by engaged scholars in this COVID-19 moment. While indeed there is lots to think and write about, the Late Industrial times we are in are also marked by a heavy saturation of information. Rather than feeling enlightening and motivated by the increased proliferation of opinions on COVID-19, I find it has the opposite effect. What other (new) forms of knowledge, processes for knowledge making, and ways of engaging in the world (not to mention education for critical consciousness) are needed in this moment? Perhaps unsurprisingly, I find the value and strength of new research collectives like this one to be rich spaces from which to start thinking about this question.

Ahmed describes the importance of a "humanist education" that trains the “ethical reflex” to open one up to forms of consciousness fundamentally different from one’s own. He notes that such openness eventually requires one to “rebel” against one’s training itself (developing critical consciousness?).

Ahmed also writes about the relationship where the intellectual refuses to speak for the subaltern--where the intellectual enters into a relationship with something foreign to him about which he will absolutely refuse ever to produce authoritative knowledge. "The point of the relationship is, in fact, "to question the grounds of knowledge itself."

The system was built to serve organizations and individuals with humanitarian goals. The system gathers data from report, reviews, and users and compiles it into comprehensible information to help inform decision-making for humanitarian concerns. Portions of the app also focus on education and technical support for field researchers looking to collect large quantities of data.

The system is primarily used by researchers, scholars, and organizations with humanitarian interests. The app also has functions which would attract users that are beginning research and do not have established connections within the field as the app provides a support system.

Twine provides information and software to set up compatible data collection systems that pool information into the larger system, which the app then makes available to its users. The system also includes a publishing and collaboration aspect which allows groups of people from all over the globe to access the same data and report on the findings together.

Data visualization is primarily determined by the type of data being gathered and the system for data collection being used. The app integrates data in order to both make large quantities of data easily viewable and understood, as well as compare studies with existing data stored on the system.

Users must be registered with the site to access any of the available features, and the registration is free. Once registered, users can immediately begin gathering their own data, analyzing the existing information, publishing reports or reviewing existing publications. The system also has several active data collection locations that are only available to registered users.
