Overview of Formosa Drainage Study

This supplementary legal document describes recommendations for storm- and waste-water management improvements for the Formosa petrochemical plant in Calhoun County, Texas. The text is a fairly standard drainage assessment. The author describes non-trivial discharge of pollutants out of the plant’s outfalls, which drain into local waters, and the inability of the plant’s systems to prevent flooding from even small storms. For some context on this, it is pretty standard to design a stormwater system to be able to drain the 100-year storm (that is, the storm with a 1% or less chance of occurring in any given year). Formosa’s Texas plant demonstrated the inability to convey even the 2-year storm.

Problem areas were identified based on the results from the outfall drainage studies provided by Formosa. Thus, all the results in the OPCC rely on those studies, uncertainities associated with those studies, and the assumptions made for those studies, some of which may or may not be appropriate as I pointed out in Supplement #2 [Page 4]” (3)

“The proposed improvements assume that the conveyance capacity of the problem areas is increased 100%, which would be able to handle twice as much flow that it currently does. The results from the Drainage Study are not conclusive as to what storm event Formosa’s system currently is capable of conveying. The report does mention that the system is not capable of conveying the 2-year storm, and “sometimes” not even the 1-year storm event. (3)

“My opinion from my July 9, 2018 report that “there have been and are still pellets and/or plastic materials discharges above trace amounts through Outfall 001” is further supported by the deposition testimony of Lisa Vitale, as representative for Freese & Nichols, Inc, that she and her colleagues have seen floating white pellets or small plastic pieces in Lavaca Bay and in the area near outfall 001 as part of her work on the receiving water monitoring program for Formosa’s TPDES permit...Ms. Vitale also testified that she told John Hyak of Formosa about these sightings as well as has sent him water samples with the pellets about five or six times, including at least one time prior to 2010. This, along with the June 2010 EPA Report I cited in my July Report, demonstrates to me that Formosa was aware of problems related to discharges of plastics from its facility since at least in 2010.” (6)

The authors examine the practice of “hot spotting,” a form of surveillance and intervention through which health care systems in the US intensively direct health and social services towards high-cost patients.  Health care hot spotting is seen as a way to improve population health while also reducing financial expenditures on healthcare for impoverished people. The authors argue that argue that ultimately hot spotting targets zones of racialized urban poverty—the same neighborhoods and individuals that have long been targeted by the police. These practices produce “a convergence of caring and punitive strategies of governance” (474). The boundaries between the spaces of healthcare and policing have shifted as a “financialized logic of governance has come to dominate both health and criminal justice” (474).

Individualizing and psychologizing the suicides, ignoring the publicness of the action and the structural causes, took away from its extreme emotional potency. Although it did spawn a good deal of activism and research, the profit margins of Apple continue to grow and Foxconn’s are shrinking. 

Automation is ignored - this topic was raised in the Dialectical Anthropology article that responded to something else that Ngai wrote and cited this piece.

Apple ”released its Supplier Responsibility Progress Report in February 2011 to show the remedial measures taken by Foxconn, its largest supplier, in the aftermath of the suicides. However, none of the ‘remedial measures’ addressed such core issues as speed-up, illegal levels of compulsory overtime work, dangerous conditions in the Foxconn factories, the humiliation of workers, and illegal practices associated with the use of student interns as workers.” -p1263

Really just denying responsibility hard: Foxconn’s “public responses to workers’ suicides were uniform: the workers who attempted suicides suffered from individual psychological problems such as depression, distress over heavy debts, or family and other personal problems (Li, 2010). Foxconn hired Western and Chinese psychologists and psychiatrists to defend it in the wake of the plague of worker suicides at the company.” p1260

 

As more specified in news articles, like Heffernan 2013, Foxconn increased wages but increased the quotas by even more. They started making workers sign anti-suicide pledges that said they wouldn’t blame the company or sue or ask for compensation. They retracted that because of outcry but then just put up nets. “Steve Jobs gamely insisted that the factory, with swimming pools and cinemas, was far better than required. The Foxconn communications director Liu Kun, argued that with more than a million employees in China alone, the rate of "self-killing" wasn't far from China's relatively high average. Everyone pledged to do better and the story went away.”

In this economist article I can’t access, but that is cited in the Wikipedia article on this topic, they also mentioned that Buddhist monks were brought in for prayer sessions.

The activists “condemned the ineffectiveness of the Chinese government and trade unions to enforce labor law and protection of the migrant workers and hence urged Apple and other brands to support genuine reform of Foxconn’s unions.” p1261 - so they are turning to the brands for labor conditions to improve.
